Copyright and Proof of Ownership

CustomFlix offers a service by which legitimate owners of video content can publish and sell their titles. We require that all our producers possess the necessary rights to sell and distribute their material through our service, and we expressly prohibit them from using our service to offer content that infringes anyone's intellectual property rights, especially copyright.

While our service is designed to prohibit a producer from offering content to which they do not own rights, it is possible to abuse our system and infringe upon a third party's intellectual property. If you believe that such a violation has occurred, please follow the procedures on this page. We sincerely appreciate your help in ensuring that everyone's rights are properly respected.

What do I do if I feel my copywritten material has been sold without my permission?

If you feel that a title offered through CustomFlix violates your intellectual property rights, we encourage you to contact us immediately. In order to properly investigate your claim we will need the following information from you:

The signature (electronic or physical) of the person authorized to act on the behalf of the owner of the rights that have been allegedly infringed

Identification of the rights that have been allegedly infringed

Your name, email address, telephone number, and street address

The URL where the material containing the alleged rights violations was purchased from or located at

A statement to the effect that you believe that the material in question, in the manner complained of, is not authorized by the rights owner, its agent, or the authorities

A statement that the information in the above notification is accurate, and under penalty of prosecution, that you are authorized to act on behalf of the owner of the rights that are allegedly being infringed

What if I am the producer of a title against which a claim is being made?

We will work with you and the other party to resolve this issue. You will be contacted concerning the claim against your content and requested to show proof of ownership. At the same time the person claiming to own the content will be contacted for the same reasons. At our sole discretion, we may put the title on hold and not offer it for sale until the claim is resolved. As stated in our Privacy Policy and Membership Agreements, we may give one or both parties the contact information of the other.

If it becomes clear that the title is in violation of another's intellectual property rights we will remove the title from your e-store and freeze payment on your account. We will then contact any customers that have purchased this title prior to the claim and ask them to return the content to us. You will be charged $10 for each title returned in this manner. Please refer to your Membership Agreement for more details.

If you have violated another party's Intellectual Property Rights, you may be liable to them for damages as well. Since you have indemnified us when you accepted the Membership Agreement, if this party sues CustomFlix, you are also responsible for paying our costs associated with your violation. What if I purchased material that violated someone's rights?

Please contact us and we will research the issue. If we find that you have purchased a title that violated a party's intellectual property rights, we will ask you to return it to us for a full refund.
