We respect your privacy. This Privacy Policy explains how we collect, share, and protect your personal information.

PLEASE NOTE: There are two different types of users of the CustomFlix Service: Customers, who purchase items such as tapes and DVDs from E-Stores, and Producers who use our service to publish their Titles and make them available for sale to Customers. This Privacy Policy covers both types of users, and sections or points which only apply to Customers or Producers are indicated below.

What information does CustomFlix gather?

Information You Give Us: We may gather and store any information you enter on our website or give us in any other way. For example, during the course of purchasing an item, Customers are required to provide us with their name, email address, shipping and billing addresses and credit card information. To publish Titles with CustomFlix, Producers are required to give us additional personal information, such as their tax ID which we use to report profits from sales. We also require additional information for each Title published, including such things as title name, running length, if it is appropriate for minors to view, etc.

Additionally, when you set up an account as either a Customer or Producer, we ask that you give us your permission to send you promotional materials. We may also ask both Customers and Producers to help us improve our service by filling out a few basic questions about the experience using our service.

You may choose not to provide certain information, but doing so may make it difficult or impossible to take advantage of some of our service's features. We use the information that you provide for such purposes as responding to your requests, customizing future shopping and services for you, improving our stores and systems, and communicating with you.

Automatic Information: We receive and store certain types of information whenever you interact with us. For example, like many websites, we use "cookies" to obtain certain types of information, such as IP number, browser configuration, and other session related details, when your Web browser accesses our website. We use this information to track the progress of your shopping session and/or Title set up, and to maintain information about our interaction with you.

E-mail: When we send you emails, we may receive a confirmation when you open our emails if your computer supports such capabilities.

Information from Other Sources: For reasons such as improving our service, we may receive information about you from other sources and add it to our account information. For example, we sometimes receive updated delivery and address information from our shippers or other sources so that we can correct our records and deliver your next purchase or communication more easily. We may also compare our Customer and Producer lists to lists received from other companies, in an effort to avoid sending unnecessary messages to you.

What does CustomFlix do with your information?

If you are a Customer placing an order through our service, our employees will use your information during the process of fulfilling your order and supporting your shopping experience. If you are a Producer publishing a Title with us, our employees will use your information to create and support your E-Store, transfer your tape(s) to DVD if applicable, generate sales reports, perform accounting functions, and all other necessary actions to support you using our service. We may also use your information to send you promotional emails and other materials if you have chosen to "opt-in".

Opt-In Policy

CustomFlix has an "Opt-in" Policy for our promotional emailing and sending of other promotional materials. This means that if you have an account with us, either as a Customer or Producer, before we will send you special offers or promotions you will already have given us your permission to do so.

If you receive a promotional email from us and you would rather not receive similar emails from us in the future, there will be a mechanism to "opt-out" in the email. You may also change your contact preferences to indicate that we should not send you any promotional emails or materials in the future, or you may send a note to Service@CustomFlix.com asking to be removed from future promotions.

However, even if you indicate that you do not wish us to send you promotional information, we will still send you invoices, sales reports, confirmations about your orders and other necessary correspondence to support our service.

How does CustomFlix share your information?

Information about our Customers and Producers is an important part of our business, and we are not in the business of selling it to others. We share personal information as described below.

Transfer to Producers: If you purchase materials from one of our Producers through our service, we will send your personal information (including email address and phone number, but not credit card information) to that Producer. To put this in perspective, if you had purchased directly from the Producer, they would have gotten this information directly from you. Our Producers agree to use your information for their own business purposes only and not to sell, rent, or transfer your information to any third party except as required to support the normal operations of their business.

Agents: We employ other companies and individuals to perform functions on our behalf. Examples include delivering packages, sending postal mail and email, removing repetitive information from our Customer lists, analyzing data, providing marketing assistance, and processing credit card payments. These agents have access to personal information needed to perform their functions, but may not use it for other purposes.

Promotional Offers: Sometimes we may send offers to selected groups of Customers and/or Producers on behalf of other businesses. When we do this, we do not give that business your name and address. If you do not want to receive such offers, please adjust your contact preferences.

Protection of CustomFlix and Others: We release account and other personal information when we believe release is appropriate to comply with law or respond to subpoenas, warrants and other legal process; enforce or apply our Conditions of Use, Membership Agreement, and other agreements; or protect the rights, property, or safety of CustomFlix, our employees or agents, our Producers or Customers, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Copyright Violations and Misrepresented Titles: If you are a Producer and use our Service to publish Titles, we may at our sole discretion share your personal and account information and relevant financial and descriptive information regarding any of your Titles with a third party should they make a credible allegation that you have violated their Intellectual Property Rights. We may likewise share this information with relevant parties if we believe that you have intentionally misrepresented Titles on your E-Store.

Acquisition: If in the event that CustomFlix or substantially all of its assets are acquired, Customer and Producer information will be one of the transferred assets.

With Your Consent: Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.

How secure is your information?

We use Secure Sockets Layer (SSL) software to encrypt sensitive information you input on our website to protect the security of your information during transmission.

We use commercially reasonable methods to secure your information, such as storing your credit card and tax ID information in an encrypted manner, using appropriate firewalls, and keeping certain servers inaccessible to outside networks.

We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.

Only employees and agents who need access to your information to perform their jobs have access to your information.

You should take appropriate measures to protect against unauthorized access to your password and to your computer, including not sharing your password with others and always logging off when you are done using a shared computer.

E-Stores

Please be aware that E-Stores are not private, and we do not control who may access a given E-Store nor who may order Titles from an E-Store. Though we may allow Producers to password protect an E-Store, we have no obligation to verify that people visiting the protected E-Store are authorized to do so.

Conditions of Use, Notices, and Revisions

If you choose to visit the CustomFlix website or any of our Producer's E-Stores, your visit and any dispute over privacy is subject to this Notice and our Conditions of Use, including limitations on damages, arbitration of disputes, and application of the law of the state of California. If you use our service to publish Titles and/or get referral commissions, you are also subject to all terms and conditions of the Membership Agreement.

This Notice, our Conditions of Use, and our Membership Agreement may change in the future, and use of information that we gather now is subject to the Privacy Notice in effect at the time of use. We may email reminders of our notices and conditions, unless you have instructed us not to, but you should check our website frequently to see recent changes.
